Drug Courts in Florida

A misdemeanor or felony drug possession charge in Florida can result in harsh criminal consequences. Not only does a conviction carry a long jail or prison sentence and costly fines, but it also leads to a permanent criminal record that can have a negative impact on employment, housing, and educational opportunities.

Fortunately, state courts understand that those who have been charged with drug possession are not seasoned criminals. Rather, they are individuals who are battling drug addiction or substance abuse and in dire need of recovery.

Florida drug courts allow first-time, non-violent offenders who have been charged with a misdemeanor or felony drug possession offense to commit to rehabilitation and obtain treatment. Once a person finishes the 18- to 24-month program, the drug possession charge will be dismissed and expunged from his/her criminal record.

The following are the requirements of the program:

  • Substance abuse treatment
  • Individual and group counseling
  • Periodic or random drug testing
  • Regular court appearances in front of a drug court judge

Individuals who have been charged with a second-time drug possession offense or a first-time drug sale or trafficking charge. Despite being eligible, the State Attorney has the authority to admit a defendant to drug court or deny their request.

According to a 2009 study by the Office of Program Policy Analysis & Government Accountability, individuals who complete a Florida drug court program were 80 percent less likely to go to prison or become repeat offenders.
