Yes, it is a crime, it can be a state crime or it can be a federal crime, in which perhaps the Secret Service might be involved in investigating it. How serious the crime is often depends on the amount that was involved in the check or in the credit card, either way, of course, it is a crime in which you could be facing potential jail time and you need an experienced criminal defense attorney in order to be able to properly handle it.
