Typically, when someone’s arrested for drunk driving, insurance companies, especially if an accident is involved, know about it immediately. They don’t cancel your insurance at that time. We still have a presumption of innocence in the United States, although many prosecutors and judges don’t really follow that, but we do have it. And the fact of the matter is, insurance companies will wait until your case is resolved before they decide whether to re-issue your policy or up the amount of your premiums. It’s critically critical that if you’re charged with a DUI, that you be represented by experienced DUI defense attorneys who can represent your interests in court and with your insurance company.
