What is forfeiture?

Back to Miami Criminal Defense Attorney Frequently Asked Questions

Video Transcription

Forfeiture occurs in a situation in which the government believes that you used a particular kind of asset and it’s now become the proceeds of criminal activity. For example, in situations of drug distribution, if a vehicle was used to distribute those drugs, then that vehicle can be forfeited. The only way in which the government can actually have you forfeit those assets is if they can actually prove that those assets were, in fact, the proceeds of criminal activity, so it’s essential to have an attorney who is experienced in dealing with those kinds of arguments so as to avoid you having to forfeit the assets that you’ve worked so hard to obtain.
