Can You Get a DUI for Riding a Bike While Intoxicated in FL?

When it comes to DUI, you may assume only drivers of motor vehicles such as cars, trucks, motorcycles, and even electric scooters are charged with this criminal offense. That is why many people think riding their bike home after drinking will help them avoid an arrest.

However, riding your bike while intoxicated can still lead to a DUI arrest in Florida. According to state law, a “driver” who operates a “vehicle” with a blood alcohol content (BAC) of at least .08 percent or while their normal faculties are impaired by drugs, alcohol, or a combination of both may be convicted of drunk driving.

While a driver is defined as anyone who operates or is in actual physical control of a vehicle, a vehicle is considered any mode of transportation that is powered by the human body or a combination of a motor and the human body. In other words, bicycles are considered vehicles, making intoxicated cyclists subject to the same DUI laws and penalties as drivers.

A first-time bicycling while intoxicated conviction is punishable by a maximum jail sentence of six months, a fine no more than $1,000 (not including court costs and other fees), and driver’s license suspension for up to one year. That’s right, even though you do not need a license to ride a bicycle, biking under the influence will still lead to the suspension for your driver’s license.
