Can I Get My Florida DUI Reduced?

If you have been charged with a DUI in Miami, FL, our legal team at Jeffrey S. Weiner, P.A. will do our best to get your entire case dismissed or obtain a not guilty verdict. However, there are some cases where either of those outcomes appears out of reach, which is why we can adjust our legal strategy to negotiate with prosecutors to reduce the DUI charge to a less serious offense, such as reckless driving.

The prosecution has the discretion to reduce a DUI to a reckless driving charge. They will review your case and determine whether it is difficult to obtain a guilty verdict at trial. So, if your blood alcohol content (BAC) was at or under the legal limit of .08 percent, if this is your first-time offense, or if you were polite and spoke coherently during your DUI arrest, there is a chance of getting your DUI reduced.

The following are the benefits of getting a reckless driving charge, rather than a DUI:

  • Less jail time – A conviction for a first reckless driving offense results in a maximum 90-day jail sentence. By contrast, a first-time DUI conviction is punishable by a maximum six-month jail term.
  • Lower fine – A first-time reckless driving conviction can carry a maximum $500 fine, while a first-time DUI conviction can result in fines of up to $1,000.
  • Less serious criminal record – Having a DUI conviction on your permanent criminal record can make it difficult to gain/keep a job, apply for college, find housing, and take advantage of other life’s opportunities. On the other hand, a reckless driving conviction doesn’t carry the same social stigma.

Jeffrey S. Weiner, P.A. can review your case, determine your available legal options, and help you obtain the most favorable results. Let us help you avoid serious penalties and get your life back on track.
